claims gave her the date rape drug ghb, and other drugs, and sexually assaulted her at his apartment. kawsar testified that when she called her brother crying, he was calm as he picked her up and drove her home. she also says later, when lee came over to her apartment, nimah and lee acted like buddies. nima momeni is accused of stabbing to death bob lee in april of last year. lee's brother reacted to shahzad's testimony outside court. at best, she was one of bob's acquaintances who wasn't his girlfriend. she wasn't wasn't close to her like she was to the rest of his family, right? in every scenario, her actions led to michael directly to my brother's death. right. and i think that everybody needs to realize that césar was one of the last people to see bob lee alive. she is a critical witness in this case because she has allegiances to both men. and the question will be, can she answer

harris was convicted, along with several others, of attempted murder and sentenced to 28 years in prison. he's maintained his innocence throughout. last week, a judge reduced harris's sentence by five years, making him a free man. but the sheriff's department says it cannot release him until it gets the order from the state department of corrections. the naacp of the silicon valley joined the supporters today, demanding his release, and in a brief telephone message, harris called the delay an injustice that was happening in santa clara county, where he is an order. it should be respected cdc. they shouldn't have that type of power. we are calling for carlos immediate release right now. right now. not tomorrow, not next day. right now. it's a lot of politics being played right now. the sheriff's department reiterated that harris's release time is determined by the state and not the county. we did reach out to the department of corrections, and a spokesperson said it was

checking into this case and would provide us details as soon as possible. frightening three days for people who live in the oakland hills. fire crews are still on site knocking down the kelter fire. that fire was our breaking news on friday. oakland fire and cal fire have been working all day monitoring conditions, checking for hotspots, taking down hazardous trees. they say they're going to stay on site again. this evening. now, they said it was able to contain the fire just over 12 acres because of that help. it received, pointing to the defensible space created by homeowners and assistance from other departments. neighbors back in their homes tonight say they're thankful it just wasn't worse. it could be worse. it could be closer. it could have knocked down. it's just safety. you're thinking at this point, it wasn't coming over here, so i wasn't worried about it. but yeah, i'm glad i still have the house. now, the fire did burn two homes, including one that's no longer livable. the fire is considered 90% contained. crews, as i said, are going to be on

site throughout the night to continue to monitor the area. officials are still trying to figure out how it started. well, some homeowners in the north bay may have helped save their own homes from a wildfire, all because they restored a neighborhood lake. they spent the past year removing weeds and algae from the lake. and as nbc bay area jodi hernandez tells us, that work paid off in more ways than one. i look out to the west and it's beautiful, so i don't ever want to miss a sunset. i love it here. jobeth fields backyard lake is once again glistening with beauty, but a year ago, totem lake in penngrove was an eyesore. after the drought, it turned into an algae covered mess. it was mostly covered in duckweed, azolla and down below was milfoil. and then the reeds had taken over quite a bit as well. beth and her neighbors teamed up to restore it. the women tried scooping the weeds out themselves, but quickly realized it was a much bigger job. after raising thousands of dollars, they hired experts to remove

76yd■!t of weeds, then bought 80 weed eating carp to keep it clean. but their goal wasn't just beautification, it was also fire protection. if there was a fire nearby and they couldn't use the lake, we were out of luck and we wanted to make sure that that did not happen. last monday, their efforts paid off when a wildfire broke out nearb, threatening homes. cal fire dipped into the lake seven times to help get the blaze under control. not only did they protect themselves, their property, their community, but also maybe a neighboring community that that benefit from that as well. cal fire's tactical air operations chief says having access to clean lakes and ponds is critical, especially in remote areas. too much algae or moss can make their equipment inoperable. a big thank you to our public, who takes the time and effort and

understands the importance of doing that. it was terrifying. at the same time. it was amazing and i also had chills from just seeing what what we had done. you know, we were able there wouldn't have been able to suck up the water if the duckweed had been there. they just wouldn't have been able to. the women say they're proud of their efforts and feel more at ease getting through the rest of the fire season. it turns out it is a good resource because it saved our neighborhood last week. last monday in sonoma county, jody hernandez, nbc, bay area news. we're learning new details tonight about a fire in sonoma county that left 30 people displaced. that fire ripped through an apartment complex in rohnert park. firefighters arrived. flames had engulfed one apartment and were quickly spreading to some more. now everyone safely was evacuated, but one firefighter did go to the hospital to be checked out. the building is no longer usable. no word on the cause or where those people are going to go at this point. two oakland cops charged with dui while on duty and today, alameda county

district attorney pamela price says she sent a strongly worded letter to oakland's police chie, but he says he never got that letter. the district attorney held a news conference this morning about the two cops charged with dui. she says she sent a letter to police chief floyd mitchell and the assistant chief outlining her concerns. she urged the department to address officer behavior. having police officers intoxicated while on duty or off duty represents a clear and present danger to the officer and the public. my hope is that you, as the new leader of the oakland police department, will develop clear policies to prevent this potentially dangerous and deadly conduct. a spokesperson for opd says neither the chief or the assistant chief received any letter from her, and only found out about all this through media reports. according to the city's website, opd offers around the clock wellness services to its officers to assist with mental

health and substance abuse problems. while the calls are getting louder for san jose city council member to step down. councilmember omar torres is under investigation for sexual misconduct with a minor. he did not show up to last city council meeting. he said he was ill, but the council will decide tomorrow if they will accept that excuse for his absence. according to the city charter, if torres misses five meetings without an accepted excuse, he could be removed. critics are calling him for to resign, saying he's lost the faith and integrity that his colleagues and constituents rely on. all of my colleagues, including the mayor, have asked for his resignation and i believe that if he if he resign, it would help our community bring us back to the trust and integrity. that's what we deserve. the investigation started with councilman torres actually went to police himself to report he was being blackmailed by someone he'd had a relationship with in the past. investigators found out the alleged extortionist was a minor. when that relationship

million to randomly to people. reaction has been quick from talk shows. i think it's something that law enforcement could take a look at. and political scientists who admit financially incentivizing someone to sign a petition is different from incentivizing someone to vote. there is a law of federal law against an inducement to vote, meaning that if somebody goes to the polling place and votes and you're outside the polling place handing out donuts, thanking them for voting, it's technically illegal in federal elections either way. don heider of santa clara university's markkula center for applied ethics calls musk's move eyebrow raising. let's elect candidates who we think will help the country do the best leading the country. and so let's not elect candidates based on some financial reward or any other kind of compensation. for now,

clear the tent encampments and bring our businesses back. are you ready to stop settling and start demanding more? join me in changing city hall. months now, and critics warned before this all happened that we'd end up paying more and some workers would lose their jobs. but a new study from uc berkeley says that didn't happen. here's investigative reporter hilda gutierrez. it's been six months since minimum wage for workers at large fast food chains in california went from $16 to $20 an hour. restaurant operators opposed the new law, claiming it would force them to raise their prices and cut jobs. but economists at uc berkeley say their data contradicts those predictions. there's a lot of

anecdotal evidence of businesses having to lay off workers because of the policy, and in the data, there is no evidence of that. the center of wage and employment dynamics at uc berkeley compared glassdoor, job post and online food menu prices two weeks before the minimum wage raise. in two weeks after, and found wages increased by 18%. employment numbers remain stable and menu prices increase by only 3 to 7%, or $0.15 on a $4 burger. benecia williams says she knows the impacts firsthand. she's been supporting her seven children on this minimum wage. i've seen a new employees getting hired, so i feel absolutely not business. they're not losing out on business. i feel that they're growing more on business because if not, why are you guys still hiring employees? but what about the

restaurant closures like the 48 rubio locations that shut down across the state? we have seen restaurants closing. we have seen rates and menu items. what would you attribute that to? that it's very rare to really see a policy like the minimum wage lead to restaurants exiting the market, unless they were already marginally on the edge of making it or not making it. but a survey given to fast food employers in july by the employment policies institute had very different results. the majority anticipated decreases in employment and significant increases in menu prices, though in the same month, the us bureau of labor statistics showed california had approximately 750,000 fast food jobs, roughly 11,000 more than when the higher minimum wage law took effect. i just feel that the ceos just

need to be fair with their workers. you know, that's what i feel overall, you know. the study comes as the california fast food council considers further increasing minimum wage in 2025. in november, voters are going to decide on prop 32. that would increase statewide minimum wage to $18 an hour. with the investigative unit. i'm hilda gutierrez. hilda. thank you. here's another story for you. as we approach halloween, trick or treaters might find less chocolate filling in their baskets this year. cocoa prices have more than doubled, according to wells fargo data. the reason bad weather has slammed west africa for three straight years. and that's where 70% of the world's cocoa is produced. this is not good news here. this is very important. companies like hershey are finding new solutions, such as reducing the size of their bars or putting less chocolate in its candy. no, that's not good. this should be a lead story here. all

right. answering the call for help. dozens of men and women from the california conservation corps are headed to florida. they boarded a flight at sacramento international this morning. 36 member team will spend the next month helping communities impacted by hurricanes helene and milton. they'll do things like remove debris from homes and businesses, cleared downed trees and move obstacles that are in the community's way. there is this this real physical labor part that is, that makes up the battle to undo a lot of the impacts of climate change. i was honored i got called upon and chosen to do so, and i'm just excited to go down there and help the people that need it. now, the california conservation corps is the oldest, largest conservation corps in the country. it always responds to natural or man made disasters. so thank you for doing that. they're going to their work is going to be very much appreciated in both of those parts of florida where those hurricanes still impacted there in a big way. and some people have been flooded out with some of that storm surge flooding

three times in two years. people don't realize how long it takes to recover from a hurricane. it really does take a very long time. yeah, you got to cut out the drywall. if you had water damage, you don't get mold. it's just going to be an ongoing process. we are looking at tropical storm oscar moving into the bahamas as we head through the next couple of days, and we also have tropical storm kristy in the pacific. that will actually bring a little tropical moisture here to california next week. we'll have more details on that. we'll take you outside right now to the current view here in san francisco. you can see that fog rolling on in and that foggy ocean breeze really helped to keep numbers from getting too hot today. look at this. we were right on spot here. santa rosa at 78. the average 76. beautiful day in concord with 77 average 77. san jose 77. and the average right here at 75. we'll stay with this trend from two different systems offshore. these areas of low pressure will keep some of the hottest air away. and it's just going to be a nice break after all that stressful weather last week when we had the warm

temperatures, the gusty winds and low humidity, this is going to ensure that we don't get into that situation here. as we move through the next seven days, so certainly some relief for us as we move into tomorrow morning. we'll start it off with some fog, some high clouds, also a little bit of sun trying to break in here through some pockets. and then as we roll through about 10:00 in the morning, we'll get sun for the east bay, south bay, most of the peninsula, and still some high clouds up to the north bay. and then there you go. we get that sunshine as we roll through tomorrow afternoon. so i think all in all, our tuesday forecast here is looking mighty fine. we're going to begin here on the chilly side. so it's that time of the year where you at least got to have that jacket close to the door. you step out. you might need it in some cases, like down here to the tri-valley, we're going to be at 49, south bay at 50. also coming in with some cool low 50s in the east bay and 48 in the north bay. daytime highs staying very similar. we're right here to 76 in napa, 79, concord 75, san jose 73, palo alto and 67 right here in san francisco. how about

rain chances ahead? so we're holding out right now until next monday to maybe get in on a little something. we got a complicated pattern here. we have high pressure to the south. looks like that's going to help to bring in some tropical moisture from what is tropical storm katie right now, kristie. rather doesn't look like that would stay a tropical storm. but again, we could get some of that into southern california for some pop up thunderstorms. low pressure to the north could bring some heavy rainfall to the pacific northwest. we're just sandwiched in between those so we could get a spotty chance next monday. it's not the big storm we need. we're already running a rain deficit here of a quarter inch to about 5800, so we need to get in on some rainfall here soon. right there on the 7-day forecast. we are into 60s and 70s this week. and for the inland valleys we're coming in with some 70s and also 80s. just really good. i keep checking the wind forecast and we're not expecting any big wind events this week. that is very encouraging news. thank you jef. up next, a new goodwill store in the south bay. and it's not just

incarcerated women in the south bay hands on retail experience. a goodwill store is open now inside the elmwood correctional facility in milpitas. women in custody will be able to work the register and help put away clothes. the prison's training program aims to help these women learn about merchandizing and sales. they'll run the store and sell to other inmates. the goal is to give them skills they can use in the workforce once they're released from prison. we taught the women how to sort products. we taught the women how to merchandise product, as you would in a goodwill silicon valley store, and make sure that they have the skills to come to work, and we can give them clothing, and once they are released, they can come to us and get a job. this is the first time a correctional facility has opened a retail store on its ground. an ansel adams photo collection has shattered dozens of auction records at sotheby's. collection features some of the photographer's most iconic images. it was auctioned off
